I have recently obtained a nearly new unit, the device is operating very well and I am pleased with it.

My question is in the recording menu it displays my recordings but there is also one plain file shown with the title "new suspects" to its right in the oblong box,I assumed this was a recording made by the former owner but when I select it so as to delete all I get is upper file displayed.

    Any ideas please.

What is happening when you select it is that you are viewing the contents of the folder. As it is an empty folder all you see is the heading i.e. the oblong box, with the option for how to get back to the media list ('upper folder').

To delete you should NOT open the folder.
Instead you highlight the folder but stop short of actually opening it. While the folder is highlighted (in the media list) press the OPT+ button on the remote (NOT the OK button which you may have been doing) and then choose 'delete'.

If it keeps on opening the folder then press 'OK' to go to the 'upper folder' and then you will be able to use the OPT+ button after highlighting the folder you want to delete.

Post #2 (by me) is just too wordy!

In the words of the Humax FAQ for 'How do I delete an upper folder?'
"Upper folder is not a folder or a file that you can delete. It is there for you to use as a 'back' function."
